Terms and conditions

Scope

These Terms and Conditions govern the use of the public website of the "Rebuild Cabana Gențiana" project (hereinafter the "Site"), including subscribing to notifications, submitting a donation pledge (pre-pledge), and, in the future, making an actual donation once the payment platform is active. By accessing the Site you confirm that you have read, understood, and accept these Terms. If you do not agree with any provision, please do not use the Site. These Terms are complemented by the Privacy Policy, which describes how we process your personal data.

Nature of donations

All amounts received through the Site are free, voluntary, and non-refundable donations (with the exception of obvious mistakes — see the "Refunds" section). By submitting a donation or a pledge you declare that the amount comes from lawful sources, that you are the holder of the payment instrument used, that you are of legal age to enter into a legal act in your country, and that you do not expect any individual good, service, or advantage in exchange. Donations exclusively fund the rebuilding of Cabana Gențiana, future maintenance, and the operational costs of the association — all audited and published on the Transparency page.

Refunds

Donations are in principle non-refundable, as they are unilateral acts made without consideration. Nevertheless, if you send an amount due to an obvious mistake (for example €1,000 instead of €10) or if the payment was made without your authorisation (fraud), you are entitled to a full refund. Send your request by email within 14 calendar days at most from the payment date, attaching proof of the transaction. We process refunds via Stripe back to the same payment instrument used for the donation, within 5–10 working days from approval of the request.

Intellectual property rights

All texts, photographs, illustrations, and graphic elements published on the Site belong to the association or to the authors explicitly named (for example, photographs donated by hikers). Use of the content for non-commercial, educational, or journalistic purposes is permitted with attribution ("Source: Cabana Gențiana, www.gentiana-retezat.ro"). Commercial use — brochures, paid advertising materials, reproduction on products — is permitted only with the written consent of the association. The "Cabana Gențiana" mark and the project logo may not be reproduced without our consent. The Site's source code is published under an open-source licence on GitHub and may be reused under the terms of that licence.

Limitation of liability

The Site is provided "as is", and the founders make reasonable efforts to ensure that the published information is accurate and up to date. However, we do not warrant the absence of technical errors, service interruptions, or editorial inaccuracies. To the extent permitted by law, the total liability of the association and its founders for any damage related to the use of the Site is limited to the amount actually donated by the user in the previous 12 months. We are not liable for indirect damages (loss of profit), moral damages, or reputational damages, except in the cases expressly provided by law.

Changes

We reserve the right to amend these Terms and the Privacy Policy where necessary — for example, when the association is officially registered, when the donation system is activated, or when the applicable legislation changes. We will announce changes on the home page of the Site and, for users subscribed to notifications, by email. The updated version takes effect 14 calendar days after publication. Continued use of the Site after that date represents acceptance of the new Terms. Previous versions are archived and may be consulted on request.

Governing law

These Terms are governed by Romanian law. Any dispute arising from or in connection with use of the Site shall first be settled amicably; if that is not possible, jurisdiction lies with the Romanian courts — the courts within the seat of the association after official registration, or the courts of the place of the act until then. Consumers resident in the European Union may use the European Commission's online dispute resolution platform (https://ec.europa.eu/consumers/odr) or alternative mediation under Directive 2013/11/EU.

For any question regarding these Terms — interpretation, application, exercise of rights, or notices of non-compliance — and for refund requests, write to the email address shown in the "Data controller" section of the Privacy Policy. We reply within 14 working days at most from receiving the request. For urgent matters related to fraud or security, please prefix the email subject with "[URGENT]" — that way the request reaches the responsible person on a priority basis. All communications may be conducted in Romanian or in English, at your choice, and the archive of correspondence is kept in accordance with the Privacy Policy.
